The FMCSA’s Final Rule – What it Means for You

March 16th is the day the FMCSA applies strict limitation on non-domiciled CDLs throughout the country.

After months of disputes over state and federal authority, the Federal Motor Carrier Safety Administration (FMCSA) is set to enact what has been dubbed their ‘Final Rule’ for obtaining a non-domiciled Commercial Driver’s License (CDL) or Commercial Learner’s Permit (CLP).  First published in February of this year, the rule is set to enforce the Department of Transportation’s stated goal of limiting eligibility for CDLs) and CLPs through more strict requirements.

The first official day of enforcement will be Monday, March 16, 2026.  The full text of the rule is available here.

The Final Rule explained


Starting on March 16th, H-2A (Temporary Agricultural Work), H-2B (Temporary Non-Agricultural Work), and E-2 (Treaty Investor) visas will be the only acceptable visas for CDLs going forward.  The rule itself does not cancel active CDLs, however the FMCSA has mandated individual states like California to cancel certain non-domiciled CDLs.

H-1B visas, Employment Authorization Documents (EADs), and other residency or work-authorization documents will no longer be sufficient obtain, renew, upgrade, transfer, or correct a CDL.

What this means for drivers and carriers


With nearly 200,000 non-domiciled CDL holders losing the ability to renew their CDLs, this can cause a major upset for motor carriers and their drivers. 

While this rule by itself does not cancel existing non-domiciled CDLs, other rules on the state level may affect a driver’s CDL status.

What you can do


Follow the FMCSA, the Department of Transportation (DOT), and your state’s Department of Motor Vehicles to keep track of updates.  There are ongoing lawsuits over the final rule and its impact on workers.  Depending on what the courts say, the enforcement of the Final Rule may change.
